FOREIGNERS AND STATELESS PERSONS’ REGISTRATION UPON PLACE OF STAY

IN THE REPUBLIC OF AZERBAIJAN

Foreigners or stateless persons temporarily staying in the Republic of Azerbaijan for more than 10 days should be registered upon place of stay. For this purpose, management of the place of stay of the foreigner or stateless person  or owner of the residential area should submit the application for registration upon place of stay and  copy of the passport (other border crossing document) of that person to the State Migration Service through official website (www.migration.gov.az) of the State Migration Service of Azerbaijan Republic, e-mail (qeydiyyat@migration.gov.az) or in person within 10 days after arrival of the person in the country.

Foreigners and stateless persons can also apply themselves in aforementioned way for registration upon place of stay.

No state fee is required for registration upon place of stay of foreigners and stateless persons.

After reception of the application form the State Migration Service of the Republic of Azerbaijan immediately by entering data of a foreigner or stateless person to Unified Migration Information System registers them upon place of stay and informs the applicant about it within 1 business day.

 

Foreigners and stateless persons are registered for the following periods:

  • Persons arriving upon visa - for the period of stay indicated on visa;
     
  • Persons arriving under visa-free regime – for 90 days.

When foreigners and stateless persons leave the place of stay, receiving party or the person himself/herself should give information about it to the State Migration Service of the Republic of Azerbaijan and according to this information they are de-registered upon place of stay. When registration period expires, foreigners and stateless persons are considered as de-registered. 

When a foreigner or stateless person changes place of stay he/she should get registered upon new place of stay in the aforementioned way.

Required documents to grant temporary residence permission to foreigners and stateless persons in the Republic of Azerbaijan

  • application form (annex) to grant temporary residence permission -  1 pcs;
     the copy of passport or any other substituting document of foreigners and the   document confirming the identity of stateless person;
  • notarized or other equally certified document confirming the existence of the cases giving basis to grant temporary residence permission;
     Foreigner’s health certificate as well as the medical certificate about not being infected by any of contagious diseases (Human immunodeficiency virus (HIV) infection,   Hepatitis B and C viruses) included in the list approved by the Cabinet of Ministers;
  • copy of the relevant document giving right to foreigners and stateless persons to reside and stay in the Republic of Azerbaijan;
     2 photos (3x4cm), against red background;
  • notarized written consent of children aged 14-17;
  • notarized copy of the document giving basis on moving to the place of residence (extract on the state registration on the property right from the state register of real estate, certificate, rent or tenancy agreement or other document specified by the legislation of the Republic of Azerbaijan);
  • application of the person who provides the citizen with the place of residence (notarized and addressed to the State Migration Service Chief);
  • notarized copy of the identity card of the person who provides the citizen with the place of residence;
  • Receipt on paid state duty (the duty is paid when temporary residence permission is given).

 

Related to health certificates foreigners and stateless persons can apply to Azerbaijan Republic Diagnostic Centre located in 3166 Tbilisi Avenue, Baku city or International Medical Centre located in 11 “B” A.Molla Juma str., Narimanov district, Baku city.

 

Granting work permit to carry out paid labour activity in the territory of the Republic of Azerbaijan to foreigners

 Application form;

 The application must contain followings:

  1. a)   For juridical persons – name of the juridical person, organizational- juridical form, juridical address;
  2. b)   For physical persons – name, surname, patronymic, data on the identity document (serial, number, time of issuance and issuing authority, address);
  3. c)   Foreigner’s name, patronymic, surname, citizenship, permanent residence address, date and country of birth, sex, profession, data on labor activity in the last 5 years, position and address of work place;  
  • Notarized copy of the document confirming possession of expert of the required educational or professional qualification to implement intended work;
     
  • Reference affirming the necessity to recruit the expert for intended work place; 
     
  • copy of the relevant document giving the right to stay in the territory of the Republic of Azerbaijan to foreigners residing in Azerbaijan for other reasons;
     
  • Foreigner’s health certificate as well as the medical certificate about not being infected by any of contagious diseases (Human immunodeficiency virus (HIV) infection,   Hepatitis B and C viruses, neuropshycological reference ) included in the list approved by the Cabinet of Ministers;
     
  • Employer: If a juridical person – the notarized copy of regulation and certificate on    state registration; If a physical person - the notarized copy of identification document and certificate on taxpayer’s registration;
     
  • Notarized copy of foreigner’s identification document.

 

Documents required for granting permanent residence permission (immigrant status) to foreigners and stateless persons in the Republic of Azerbaijan

Able-bodied foreigners and stateless persons have turned 18 years and temporary residing in Azerbaijan Republic on legal bases for a minimum period of 2 years can apply to the State Migration Service for permanent residence (immigrant status).


The application is supplemented with the following notarized or other substituting documents: 

  • birth certificate or other equal substituting document;
     
  • reference on family composition (indicating names, surnames, dates of birth, employment of family  members and their place of being and residence), copy of marriage certificate, written consent (on immigration) of 14-18 years old children immigrating with the foreigners and stateless persons;
  • health certificate of immigrating persons about not being infected by any of contagious diseases (Human immunodeficiency virus (HIV) infection,   Hepatitis B and C viruses) included in the list approved by the Cabinet of Ministers;
  • document confirming availability of means to cover minimal needs of foreigners or stateless persons and their family members, except the cases if their expenses are covered by the citizen of Azerbaijan Republic or the person permanently resided in Azerbaijan Republic;
  • foreigner’s passport or document confirming statelessness of stateless person;
  • document certified specialty of foreigners or stateless persons;
     4 photos (3x4 cm) against red background;
  • copy of the document giving basis on moving to the place of residence (extract on the state registration of the property right from the state register of real estate, certificate, rent or tenancy agreement or other document envisaged by the Azerbaijan Republic legislation);
  • application of the person who provides the foreigner with accommodation (application must be addressed to the State Migration Service Chief);
  • copy of the identity card of the person who provides the citizen with accommodation.

 

Related to health certificates foreigners and stateless persons can apply to Azerbaijan Republic Diagnostic Centre located in 3166 Tbilisi Avenue, Baku city or International Medical Centre located in 11 “B” A.Molla Juma str., Narimanov district, Baku city.

 

 Extension of temporary stay

 In accordance with the Migration Code of the Republic of Azerbaijan a decision on extension of temporary stay of foreigners and stateless persons in the Republic of Azerbaijan is an official document empowering foreigners and stateless persons to temporary stay in the Republic of Azerbaijan.

 Foreigners and stateless persons, who have extended their temporary stay in the Republic of Azerbaijan can exercise their right to leave the country by submitting their passports or other documents allowing to cross the border including approval by the authorities on extension of temporary stay.

A temporary stay period for a foreigner or a stateless person in the Republic of Azerbaijan may be extended on the basis of an application of his/her parents or his/her legitimate representatives up to  60 days.

 A temporary stay period for a foreigner and a stateless person under 18 in the Republic of Azerbaijan may be extended on the basis of an application of his/her parents or his/her legitimate representative.

 Foreigners and stateless persons have to apply to an appropriate authority of the executive power by submitting documents required for the extension of a temporary stay at least 3 days prior to the end of a temporary stay period (except cases of emergency stop during  transit).

 Relevant decision on an application of foreigners and stateless persons on extension of temporary stay in the Republic of Azerbaijan is made within 3 business days.

A foreigner or a stateless person whose application for the extension of a temporary stay is rejected should leave the country before expiration of the temporary stay.

If a temporary stay period of a foreigner or a stateless person in the Republic of Azerbaijan is expired during a period of consideration of an application, he/she has to leave the territory of the country within 48 hours from the moment of receiving a decision on rejection.

In accordance with the Presidential Decree N 69, dated March 04, 2009 “On the application of a “single window” principle for the management of a migration process”, a “single window” principle was applied in the Republic of  Azerbaijan since July 1, 2009. State Migration Service of the Republic of Azerbaijan (www.migration.gov.az) implements the authority of single state body on this principle. 

 I.e. extension of a temporary stay period for foreigners or stateless persons visiting  the Republic of Azerbaijan; issuance of permissions to foreigners and stateless persons for temporary and permanent residence in the Republic of Azerbaijan; registration of people allowed to temporary stay and to reside in the Republic of Azerbaijan and other functions are performed by the State Migration Service of the Republic of Azerbaijan.

The Ministry of Foreign Affairs of the Republic of Azerbaijan carries out registration, visa issuance, extension of a temporary stay period in the Republic of Azerbaijan for the following category of people:

Members of staff of diplomatic missions, consulates of foreign countries, representations of international organizations functioning in the Republic of Azerbaijan and their family members;

  • Members of technical service staff of diplomatic missions and consulates of foreign countries, representations of international organizations functioning in the Republic of Azerbaijan and their family members;
  • Foreigners and stateless persons visiting the Republic of Azerbaijan for a diplomatic or a special purpose stipulated by international agreements supported by the Republic of Azerbaijan.

 

Required documents for extension of temporary staying period of foreigners and stateless persons arriving in the Republic of Azerbaijan

 

  • application form for extension of temporary staying period -1pcs;
  • passport or any other substituting document of foreigner and the document confirming stateless person’s identity;
  • 2 photos (3x4 cm), against red background;
  • document confirming the occurrence of the cases giving basis for extension of temporary staying period;
  • document confirming the registration of foreigners or stateless persons intending to stay in the Republic of Azerbaijan more than 30 days;
  • notarized written consent of children aged 14-18;
  • notarized copy of the document giving basis on moving to the place of residence (extract on the state registration on the property right from the state register of real estate, certificate, rent or tenancy agreement or other document specified by the legislation of the Republic of Azerbaijan);
  • application of the person who provides the citizen with the place of residence (notarized and addressed to the State Migration Service Chief);
  • notarized copy of the identity card of the person who provides the citizen with the place of residence;

 

Note: Temporary staying period of foreigners and stateless persons in the Republic of Azerbaijan is extended in the following cases:

 

  • necessity for urgent treatment in Azerbaijan Republic;
  • serious illness or death of close relative living in Azerbaijan Republic;
  • incompleteness of the intended work connected with official necessity.
